Money Laundering Case: The hearing on framing of charges against co-accused Jacqueline Fernandes in Sukesh Chandrasekhar’s multi-crore fraud case was adjourned for December 12. On December 12, Delhi’s Patiala House Court will hear the arguments of the lawyers of all the accused before framing charges against all the accused including Sukesh Chandrashekhar.
Only after hearing the arguments, the court will decide whether the allegations made by the Delhi Police in the charge sheet against Sukesh Chandrasekhar and Jacqueline Fernandes are made out or not. During the arguments on framing of charges, Jacqueline Fernandes’s lawyer will try to tell the court with his arguments that the allegations made by the Delhi Police in the charge sheet filed against Jacqueline are completely baseless. Accused Jacqueline was not aware of this fraud and she herself has become a victim of it.
Jacqueline will defend herself before the court
After the arguments on framing of charges, the court will decide whether Delhi Police has prima facie facts to prove the allegations mentioned in the charge sheet or whether Jacqueline’s stand is prima facie. as correct. If the court is satisfied with Jacqueline’s side, it can also drop the allegations made in the charge sheet filed by the Delhi Police. Or it is also possible to remove some of the sections from all the sections and continue the trial in the rest of the sections.
If the court feels that the allegations made in the charge sheet filed by the Delhi Police are not initially found to be true before the court, then the court can give relief to Jacqueline without framing the charges, that is, it can free the charges. But if the court feels that the allegations made against Jacqueline in the charge sheet of Delhi Police can be proved initially, then the court will proceed with the trial by framing charges under those sections. That is, Jacqueline’s difficulties will increase or she will get relief, it can be clear to a great extent from the order of the court to decide the charges.
